The passage in question clearly states "material posted or transmitted using the Service may be copied, republished or distributed by third parties". "Posted or transmitted" could include Web posts, emails, or any other information. It may be immoral or unethical in some sense to use this information, but, from the terms of service, it seems legal.

Also, make no mistake: Anonymity on the Web is non-existent, by its very nature, when you get to the ISP level. Server A has to be able to communicate with Server B, and both servers need to know who you are (i.e., your IP address). Any sufficiently-determined person with access to the logs of these communications can track you.

While there should probably be laws against ISPs sharing access information to third parties, when you access the Internet, you do so with the understanding that you leave tracks that the authorities can trace. If that gets your hackles up, don't conduct sensitive business online.
