Extremely difficult to define in legalese
The problem is that it would be nigh impossible to define spyware with the kind of accuracy and detail that would be needed to make a significant dent in it. Laws came around that said they must notify users that the software is to be installed, so companies buried this information in EULAs that almost nobody reads (unless they can speak legalese AND techie, and are either bored or paranoid). Plus, as others have said, one person's spyware is another person's "useful" application (see Gator and CometCursor).

I'm not saying we shouldn't try, just that it won't be easy and will probably have to be re-done several times to clean up loopholes.
