Involve the ISPs
One obvious channel of discipline is via ISPs. They are in a position to shut down users (malicious or zombie) speedily.
ISPs should be required and obliged to publish, maintain and operate an abuse e-mail account - not all do. They could also publish abuse reporting standards and recommendations.
Users should be more proactive in reporting apparent abuse.
A small increase in the prevalence of this practice would make a very big difference.
At present, there seems to be so little "prove guilty (even if unknowingly)" activity that we have a growing "guilty until proved innocent" culture. This is most undesirable.
