As with all things dealing with the legal system, it depends. Depends on who you are, how much money you have, whether you are buddies with the mayor, etc.

But, seriously, I think the issue is exploitation of a minor and what was done with the photos. Photographing a minor and under what conditions is a sticky issue for legit photographers. If it's used for kiddie porn, there is no justification for it under the rules of contemporary society.

BTW, if you go to a nude beach & photograph someone, use that photograph in a commercial venture or to riducle (either the person or them as an icon for something else), without obtaining a model's release, you can be sued and will lose. If it is a general photograph of a group, (such as Weegee's work) you might get away with it. Ditto for someone's property such as their home. Ditto for the person on the street. A few years back, a judge found in favor of a Mexican citizen that had been photographed (in Mexico) and the photograph used to ridicule him. Pretty dicey stuff for photographers, but has nothing to do with encryption software.
