- The problem is precedent
- Our legal system uses the theory of precedent. This means that judges rely on previous decisions to guide them in judging a case. The thought that posession of an encrytion program is evidence of criminal intent is an incredibly dangerous precedent. The fact this was a child porn case makes the inclusion of the precedent even more dangerous, because it won't be questioned nearly as much as it would be, say, in an embezzlement case.
