1) They're right, if the computer already has the spyware/virus/trojan on it, it's already comprimised and there's easier ways to get stuff from it.

2) Being a hardware bug, I imagine it's probably a lot harder to implement than finding a software loophole. Low level hardware stuff is more difficult to do than the higher level software stuff.
