What dictionary are you using?: Merriam-Webster says:

fiduciary:
: of, relating to, or involving a confidence or trust: as a : held or founded in trust or confidence b : holding in trust c : depending on public confidence for value or currency

There's no mention of assets, legal authority, or financial matters in the definition. "Fiduciary responsibility" is just a way to say that a person/entity trusted by others should act responsibly based on that trust. By not encrypting their data Time Warner broke that trust and therefore should be held responsible.

When a bank is robbed they are responsible for the stolen money, regardless of any security measure they might have taken prior to the robbery.
